I-TRADEMARKS
Our Trademark Law establishes that only two documents are required, for filing a trademark application in Panama:
- Power of Attorney; and
- A document which proof that the company exist. This document could be a Notarial Certification or a Certification from the company Registry Office who certifies that the company exists. Only one of the two documents is required.
The Power of Attorney and the proof of existence of the company have to be duly Authenticate with the Apostill Seal of the Hague Treaty of October 5, 1961 or by the Panamanian Consul (only one Authentication is required, use the one who it’s easier for you to obtain).
Also it’s possible to file a Trademark Application without the above mentioned documents, acting as Officially Agent, but in this case the cost and the fees will increase.
When a Trademark is file without the documents requested by our Law (as Officially Agent), the term for filing the said documents is TWO (2) MONTHS AND IT COULD BE EXTENDED FOR ONE (1) MORE. After this maximum three (3) months period if the documents are not file the bond it’s lost and the Application is conclude.
The general process for filing and Registering a Trademark Application in Panama is:
– Filing
– Official examination
– Publication (for opposition purposes)
– Registration
II- PATENTS
The necessary documents to file a Patent in Panama are:
-Power of Attorney
-A document which proof that the company exist. This document could be a Notarial Certification or a Certification from the company Registry Office who certifies that the company exists. Only one of the two documents is required
-An Assignment of the Invention (if the Applicant is not the Inventor of the Patent).
The Power of Attorney and the proof of existence of the company have to be duly Authenticate with the Apostill Seal of the Hague Treaty of October 5, 1961 or by the Panamanian Consul (only one Authentication is required, use the one who it’s easier for you to obtain).
